1. ACCEPTANCE

By creating an account on AutomaticPilot.ai, you confirm that you have read, understood, and agree to these Terms of Service in their entirety. If you do not agree, you may not use the service.

2. THE SERVICE

AutomaticPilot.ai is a SaaS platform that uses artificial intelligence systems to generate images, videos, audio, and text for social media, based on user instructions.

3. ELIGIBILITY

You must be at least 18 years old to use this service. By registering, you confirm that you meet this requirement.

4. USER RESPONSIBILITY

You are the sole and exclusive responsible party for:

• All content you generate, approve, and publish through the platform

• Ensuring you hold all rights, permissions, and licenses over any material you upload or use as input

• Complying with the laws applicable in your jurisdiction regarding AI-generated content, including its labeling and public disclosure

• Ensuring that published content does not violate third-party rights, including image rights, privacy, intellectual property, or trademarks

SKEYFACTOR LLC does not review, moderate, or approve content before publication and holds no editorial control over it.

5. PROHIBITED USES

You may not use AutomaticPilot.ai to generate or publish content that:

• Is false, misleading, or disinformative

• Defames, harasses, or threatens individuals

• Violates the privacy or image rights of third parties

• Infringes intellectual property rights

• Is obscene, pornographic, or involves minors

• Serves political purposes without legally required disclosures

• Violates any local, state, federal, or international law

6. LIP SYNC, VOICE, AND DEEPFAKE CONTENT

The use of Lip Sync and Voice Over features involves creating synthetic content using images and/or voices. By using these features, you guarantee that:

• You have the explicit, informed, and documented consent of any person whose image, voice, or likeness you use

• You understand that creating synthetic content of real people without their consent may constitute a criminal offense in multiple jurisdictions

• You assume full legal responsibility arising from the use of these features

7. AI-GENERATED CONTENT — DISCLOSURE

All content produced by AutomaticPilot.ai is generated by artificial intelligence. In compliance with the EU AI Act (Art. 50, effective August 2, 2026) and the California AI Transparency Act (SB 942):

• Content carries machine-readable technical marks identifying its AI origin

• Content may carry a discreet visual mark indicating its AI origin

• You must not remove, hide, or alter these marks

8. INTELLECTUAL PROPERTY

• You retain rights over the inputs you provide

• SKEYFACTOR LLC does not claim ownership over generated content

• You are responsible for verifying that generated content does not infringe third-party rights

• SKEYFACTOR LLC does not guarantee that generated content is original or free from IP conflicts

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

• SKEYFACTOR LLC does not guarantee that generated content is accurate, appropriate, original, or fit for any particular purpose

• SKEYFACTOR LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the service or generated content

• SKEYFACTOR LLC's maximum liability to you shall not exceed the total amount paid in the 3 months prior to the event giving rise to the claim

• This limitation applies even if SKEYFACTOR LLC has been advised of the possibility of such damages

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless SKEYFACTOR LLC, its directors, employees, and agents from any claim, damage, fine, or expense (including legal fees) arising from: the content you generate or publish, your violation of these Terms, or your violation of third-party rights.

11. MODIFICATIONS

SKEYFACTOR LLC may modify these Terms at any time. Continued use of the service after notification constitutes acceptance of the changes.

12. GOVERNING LAW AND JURISDICTION

• This agreement is governed by the laws of the State of Delaware, USA

• For European Union users: the rights under GDPR and the EU AI Act additionally apply; disputes may be submitted to the competent courts of the user's Member State

• For LATAM users: the parties agree to the jurisdiction of Delaware courts as the exclusive forum
